Terms of Sale

Effective date: August 25, 2026

These Terms of Sale (“Terms”) govern the purchase of digital products sold by Accessiblü Solutions, LLC (“Accessiblü,” “we,” “us,” or “our”) through accessiblu.com. By placing an order for any product listed below, you agree to these Terms. If you’re purchasing on behalf of an organization, you’re confirming you have the authority to bind that organization to these Terms.

1. Products and Pricing

Accessiblü currently offers the following digital products through our website:

Prices are listed in U.S. dollars and are subject to change without notice. The price in effect at the time your order is placed and payment is processed is the price that applies to that order.

2. Payment Processing

Orders are processed through WooCommerce and Clover. By submitting payment, you authorize us to charge the payment method you provide for the full purchase amount. We do not store your full payment card details; that information is handled directly by our payment processors.

3. Sales Tax

Prices are shown in U.S. dollars and do not include sales tax. We do not currently collect sales tax at checkout. Depending on your location, your organization may still owe use tax on this purchase; determining and reporting that is your responsibility. We may begin collecting sales tax in future, in which case it will be shown at checkout before you pay.

4. Delivery

All products are delivered electronically. Once your payment has been successfully processed, you will receive your purchased product by email at the address provided at checkout. Files are provided in PDF, Word, and HTML formats.

Please double-check your email address at checkout. If you don’t receive your files within one business day, or if you have any trouble opening or accessing a file, email jeff@accessiblu.com and we’ll get it sorted out.

5. License Grant and Restrictions

License scope. When you purchase a product, we grant your organization a single-organization, non-exclusive, non-transferable license to use that product internally. “Your organization” means the single government entity, agency, department, or other organization on whose behalf the product was purchased.

Internal sharing is fine. You may share the files with employees, staff, and departments within your own organization. For example, if a county purchases the Handbook, that county’s staff across departments can use it.

Sharing outside your organization is not. The license does not extend to any other organization, agency, or entity, even one that is similar to or affiliated with yours. A copy purchased by one county, city, or agency may not be shared, forwarded, emailed, printed, uploaded, or otherwise distributed to a different county, city, agency, contractor, or other outside organization. Each organization that wants to use the product needs its own purchase.

No resale or redistribution. You may not resell, sublicense, rent, lease, or otherwise redistribute the products, in whole or in part, in any format (PDF, Word, HTML, or otherwise).

If we determine a product has been shared or distributed outside the licensed organization, we reserve the right to refuse future updates or support to the associated account.

6. Refund Policy

All sales are final. Because these are digital products delivered electronically, we do not offer refunds or exchanges once a file has been delivered. Please review product descriptions carefully before purchasing. If you believe you were charged in error or received the wrong product, contact jeff@accessiblu.com and we’ll work with you directly.

7. Updates and Support

Updates. For 12 months from your purchase date, you may email jeff@accessiblu.com to request the current version of your purchased product if it has been revised or updated since your purchase.

Access support. If you have trouble downloading or opening your files at any time, email jeff@accessiblu.com and we’ll help you get access.

8. Intellectual Property

All content in these products, including text, structure, checklists, templates, and design, is the property of Accessiblü Solutions, LLC and is protected by copyright. Your purchase gives you a license to use the content under the terms above. It does not transfer ownership or grant any right to reproduce, publish, or create derivative works for distribution outside your organization.

9. Not Legal Advice

These products are educational and compliance resources. They are not legal advice, and purchasing or using them does not create an attorney-client relationship between you and Accessiblü Solutions, LLC or any of its consultants. ADA, Section 508, and WCAG compliance involves fact-specific legal questions, and we recommend you consult qualified legal counsel regarding your organization’s specific obligations and risk.

10. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or a purchase made under them will be resolved in the state or federal courts located in Stark County, Ohio, and you consent to the jurisdiction of those courts.

11. Limitation of Liability

To the fullest extent permitted by law, Accessiblü Solutions, LLC’s total liability arising out of or relating to a purchase under these Terms will not exceed the amount you paid for the applicable product. We are not liable for indirect, incidental, consequential, or special damages, including any liability, penalty, or loss arising from a third-party accessibility claim, even if we’ve been advised of the possibility.

12. Changes to These Terms

We may update these Terms from time to time. The version posted at accessiblu.com at the time of your purchase governs that purchase.
